Welcome to Finder (“Finder,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Finder mobile application, website, and related services (collectively, the “Service”).

By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement and consent of a parent or legal guardian.

By using the Service, you represent and warrant that you have the legal capacity to enter into these Terms.

2. Description of Service

Finder is a digital inventory and organization platform that allows users to catalog, organize, search, and manage information about personal belongings and storage locations.

Finder is provided for informational and organizational purposes only.

Finder does not guarantee the existence, condition, location, ownership, value, or recovery of any item entered into the Service.

3. User Accounts

To access certain features, you may be required to create an account.

You agree to:

  • Provide accurate and complete information.
  • Keep your account credentials secure.
  • Maintain the accuracy of your account information.
  • Notify us immediately of any unauthorized use of your account.

You are solely responsible for all activities conducted through your account.

4. User Content

You retain ownership of all content you upload, submit, store, or create through the Service, including but not limited to:

  • Item records
  • Photos
  • Notes
  • Tags
  • Location information
  • Documents and attachments

By submitting content to the Service, you grant Finder a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display such content solely for the purpose of operating, improving, and providing the Service.

You represent and warrant that:

  • You own or have the necessary rights to the content you submit.
  • Your content does not violate any law or third-party rights.
  • Your content is not fraudulent, defamatory, obscene, or unlawful.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Upload malicious code, viruses, or harmful software.
  • Attempt to gain unauthorized access to the Service.
  • Interfere with or disrupt the Service.
  • Reverse engineer, decompile, or attempt to extract source code.
  • Use automated tools to scrape, harvest, or copy Service data.

We reserve the right to suspend or terminate accounts that violate these Terms.

The Service, including its software, design, branding, logos, trademarks, features, content, and technology, is owned by Finder or its licensors and is protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, no rights are granted to you.

7. Subscription Services

Certain features may be offered through paid subscriptions.

Subscription fees, billing cycles, and available plans will be displayed before purchase.

Subscriptions automatically renew unless canceled before the renewal date.

You may manage or cancel subscriptions through the applicable app marketplace or payment provider.

Except where required by law, payments are non-refundable.

8. Future Features and Modifications

We may modify, update, suspend, or discontinue any part of the Service at any time.

We may introduce new features, functionality, pricing models, or subscription tiers without prior notice.

We are not liable for any modification, suspension, or discontinuation of the Service.

9. Data Storage and Backup

Finder is designed to help users organize information; however, no storage system is completely secure or error-free.

You acknowledge that:

  • Data loss may occur.
  • Technical failures may occur.
  • Synchronization delays may occur.

You are responsible for maintaining independent backups of important information.

Finder does not guarantee uninterrupted availability or permanent preservation of user data.

10. Privacy

Your use of the Service is also governed by our Privacy Policy.

By using the Service, you consent to the collection, use, and processing of information as described in the Privacy Policy.

11. Third-Party Services

The Service may integrate with or rely upon third-party providers, including cloud storage providers, analytics providers, payment processors, and authentication services.

Finder is not responsible for the actions, policies, availability, or performance of third-party services.

Your use of third-party services may be subject to separate terms and conditions.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINDER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY
  • RELIABILITY
  • AVAILABILITY

WE DO NOT WARRANT THAT:

  • THE SERVICE WILL BE UNINTERRUPTED;
  • THE SERVICE WILL BE ERROR-FREE;
  • DEFECTS WILL BE CORRECTED;
  • THE SERVICE WILL MEET YOUR EXPECTATIONS;
  • ITEMS RECORDED IN THE SERVICE CAN BE LOCATED, RECOVERED, OR VERIFIED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINDER, ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, CONTRACTORS, AND LICENSORS SHALL NOT BE LIABLE FOR:

  • INDIRECT DAMAGES
  • INCIDENTAL DAMAGES
  • SPECIAL DAMAGES
  • CONSEQUENTIAL DAMAGES
  • LOSS OF DATA
  • LOSS OF PROFITS
  • LOSS OF GOODWILL
  • LOSS OF BUSINESS OPPORTUNITIES
  • LOSS OF PROPERTY

ARISING OUT OF OR RELATED TO THE USE OF THE SERVICE.

IN NO EVENT SHALL FINDER’S TOTAL LIABILITY EXCEED THE GREATER OF:

(A) THE AMOUNT PAID BY YOU TO FINDER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR

(B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).

14. Indemnification

You agree to defend, indemnify, and hold harmless Finder and its affiliates, officers, employees, contractors, and licensors from any claims, damages, losses, liabilities, costs, or expenses arising from:

  • Your use of the Service;
  • Your content;
  • Your violation of these Terms;
  • Your violation of any law or third-party rights.

15. Account Suspension and Termination

We may suspend or terminate your access to the Service at any time if:

  • You violate these Terms;
  • We reasonably believe your conduct poses a risk to the Service, users, or third parties;
  • Required by law.

Upon termination, your right to use the Service immediately ceases.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

17. Changes to These Terms

We may revise these Terms from time to time.

If we make material changes, we may provide notice through the Service or by other reasonable means.

Your continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms.

19. Entire Agreement
